A judge has stalledÂ a court order created last week that would reuniteÂ Kelly Rutherford withÂ her children, who are currently in Monaco with her ex-husband.
According toÂ theÂ Associated Press,Â family court Judge Maren E. Nelsonâ€™s decision will keep theÂ Gossip GirlÂ starâ€™s two children, Hermes, 8, and Helena, 5, from being flown toÂ Los Angeles for a June 15 custody hearing.
Her ex husband,Â Daniel Giersch,Â has an attorney whoÂ is arguingÂ that Monaco, not California, hasÂ jurisdiction over the children.Â Gierschâ€™s lawyerÂ saidÂ Rutherford â€œmade fraudulent statementsâ€ and â€œliedâ€ to be grantedÂ temporary sole legal and physical custody on May 22.Â
The AP reports that Nelsonâ€™s decision prevents Rutherford from taking custody of the children untilÂ Monaco and L.A. judges discuss the case on June 11.
Giersch and Rutherford were married inÂ 2006 and filed for divorce in 2008. Rutherford has been fighting to bring her children back to the United States since 2012, when a judge ruled that they would live in Monaco with their father (though the parentsâ€™ shared custody) because Gierschâ€™s visa was revoked. RutherfordÂ even created a White House petition to get her kids back,Â which garnered support from friends like Ed Westwick and celebritiesÂ likeÂ Kim Kardashian.
